"In response to the Patricia Court parking issue, yes, Sun Chemical was asked if Patricia Court residents can park in the lot after working hours. They responded that they do offer a Sun Chemical parking sticker if you provide proof of residency and submit a letter stating that you will not hold Sun Chemical liable for any legal issues such as injury or property damage to your car. Call Joe Patti at Sun Chemical to inquire."

"Many times I ride down Paricia CT and I never see anyone using their garages. I do see the doors open and no cars parked in the garages. A lot of bikes, grills, and whatever. "Just a thought that you residents of Patricia Court might consider. Those homes were authorized to be built by the previous administration\'s Planning Board in 1995. As stated many times, the Planning Board stipulated that there would be no parking allowed on the narrow street primarily because of fire safety and other emergency response issues. Obviously, you were never informed of this by the developer when you purchased your home and the no parking signs were never installed prior to all the homes being sold. I guess you can say you were deceived. You were advised to seek remedy against the developer when you first appeared before the new administration when it took control in 1996, but for some reason you never did so. Besides using your garages for storage instead of parking cars, your only alternative is to take Sun Chem up on its offer. However you also might consider a tax appeal on the assessed value of your home based on the lack of parking provided on the street, which was approved by the town. The no parking situation has to have an impact on the re-sale (market value) of your property"

"In response to the Patricia Court parking situation, the driveways and garages are being used and if you are driving down Patricia Court during the day most of us are not home. Don't forget these are two family homes and I'm sure the owners are not going to let their tenants use their garages and driveways.

Since this is not a discussion forum, I will sum up the last two submitted comments. One person wishes to remind the residents of Patricia Court that by ordinance they must provide off-street parking for tenants. Another contributer thinks it is unfair to continually advise the residents of Patricia Court to seek redress from a long gone developer. He/she would also like to know if there is a phone number for the person to contact at Sun Chemical and how does the town plan to notify residents that do not read this page that they can obtain parking stickers from Sun Chemical?

"You cannot park "on your driveway curve" which I assume means on the street blocking your driveway unless you apply for a permit from the Borough. There is an annual fee which I believe is $25. You can apply for a overnight parking permit for an out of state registered car if it is your regular business vehicle upon submitting the proper proofs to the Zoning Dept. At any rate, I wouldn't get too concerned due to enforcement being somewhat dubios unless a neighbor complains enough about any violations."

There is no fee for getting a parking permit. However, as noted the rules for overnight parking are about to change. The new ordinance will make it illegal to park without a sticker from 2am to 9am.

"In the interest of clarity: The resident asked if he could park on the "curve" of his driveway. If he/she mis-typed and was referring to the curb line at the driveway opening, there is a permit required for which an annual fee is charged. If he/she meant the grade at the driveway entrance extending across the sidewalk, the answer is no, you cannot block the sidewalk."

From the Borough of Carlstadt Ordinances:

10-3.11 Permit Parking.

a. In Front of Private Driveways.

Paragraph 3. Eligibility; Limit; Display. An owner of a private driveway shall be eligible to apply for one permit for his/her own motor vehicle or for a member of the household or a tenant therein authorized by the owner to park in front of the private driveway. [cut . . .] In no event shall there be more than one permit issued per private driveway. The permit shall be 5 1/2" x 8 1/2" in size, shall bear an appropriate certification of authenticity and shall be displayed prominently within the vehicle when it is parked so as to be seen from the middle of the street.

Paragraph 5. Restrictions. A motor vehicle shall not be permitted to be parked in front of a private driveway unless the owner of the private driveway or a member of the owner's household or a tenant has been issued a valid permit and the permit is properly displayed.

"my post regarding a permit fee for parking in front of your driveway (as in: to block the same) is covered in ordinance section 10-4 at page 1007 entitled Fee: renewal. It references the Schedule of Fees in Chapter IV @ 4-8.2 which sets the initial permit fee at $35.00 and the renewal fee at $5.00."

"The ordinance was adopted in 1994 to accomodate a resident who was getting tickets because a yellow line covered the entire frontage of his home. He had nowhere else to park except his driveway, which is a no-no for many of our neighbors. Ha! It was issued by the Boro clerk, I believe.

"Is the structure in progress at 752 7th Street in violation of height regulations and the 2 1/2 story rule or were variances granted? The garage is not submerged and although built on an incline the roof appears at least 5' above the similiarly built house adjacent to it. I don't remember granting such a variance but I don't have the plans handy to check. And even if a story-rule variance was granted because of the grade, the house would still have to obey the height rules. It couldn't be over 32ft. --N

"The house next door is street level. The house that is being built is at least 3ft above grade. The plans show 32ft when the are done they must give a set of plans which are called as built. If is higher then 32ft they have to go back to the planning board for a variance."

Isn't the Borough obligated to make periodoc inspections to assure construction code as well as zoning compliance? I think what Tommy meant was that if the plans the builder supplies to the construction dept. don't agree with the plans he (Tommy) receives from planning, then the builder has to go back to planning for a variance before building. There are no after-the-fact variances. If the builder builds without meeting code, he is responsible for all costs to rectify the matter. This happened to Thelma's old house on Hoboken Rd. The new owner had to rebuild his foundation when he made it oversized. -Nick

A builder has two years to build after receiving his approval from planning. That building was approved before the latest ordinance was adopted. -N

"The building dept goes to the job site to do inspections when the builder calls for inspections. They also go to look at the job at times. They don't baby sit on the job site. Maybe the town should hire baby sitters for every job in town."

"Nick, FYI. I spoke with Tommy Cox yesterday and he confirms that an inspection determined that the house is too high. The problem I see and have experienced in the past is that the height regulation is often confused with the the 2 1/2 story regulation being one in the same. I was also surprised to learn that there is no coordination between zoning and the Planning Board and he is under the erroneous impresssion that his authority is superceded by the Planning Board i.e., if you approve a project in violation of the ordinance and do not grant variances, he has no authority to deny approval for permits. I assume every member gets a copy of the current Cox book (The Planning and Zoning Bible). I wonder if anyone ever refers to it. "

If the house is taller than the plans approved by the planning board then it must be lowered. It is the zoning officer's responsibility to put a stop work order on the project until the problem is rectified. If the house is completed, than it can not get a CO until the problem is rectified.
The coordination between planning and the zoning officer is done through the town clerk and through the construction plans. There shouldn't be any confusion over what is to be built because it is all in the plans and the application and approval documents.
The planning board can not approve plans that do not meet ordinance without a variance. To do so would be illegal. -Nick

You say that the builder deviated from the approved plan and then draw the conclusion that the Board approved an illegal structure. I don't follow the logic. The builder hasn't been back before the board for approval of illegal modifications. If the building is in violation, then it must be brought into compliance.

"Why don't the carpenters build the house and then measure and apply for the permits. If they pass the height they are granted the permits. If they don't pass the height the town should not issue the permits. That's what the electricians do. They wire the building and then count the recepticals and file for the permit."

"Unless revised, I refer you too Chapter XX, Re; soil removal at 20-3:
'no person shall excavate or alter the grade of a property without first obtaining a permit from the Planning Board.'
There are exceptions, however the circumstances of this particular lot will cause a drainage problem and should not qualify for and exception. The excavation also allowed for the violation of the 2 1/2 story rule based on the ordinances. I also refer you too: Chapter XXI, definitions for "basement" and "story" and also 21-5 re: schedule limiting height and bulk, especially to the restriction regarding the number of allowable stories for residential properties being 2 1/2. I thought you were referring to large-scale soil removal which only the county can permit. Small scale excavating and grading is approved by the planning board. My mistake. -Nick

"Hi, I think once per week, there is a huge truck loading goods for the Quiznos Sandwich shop on the early mornig around 5am or 6am on the end of the Division st (near RT17). When they are loading the goods, they make very laud noise, and wake us up in the very earily morning. My question is whether the truck can double park on the Division st for loading goods? why don\'t they park in front of the Quiznos store. And, whom can we complain to about these laud noise when they are loading goods? Thx."

They're not supposed to unload from Division under any circumstances. You should call the police when this happens. You should also report this to Cheryl James at the board of health.

"On this Monday, the truck came again around 6AM on the Division st. The guy also turn on the radio very loud when he was loading goods for the Quizno store. I called the police, but the officer said he would lookup the rule and take care of this. However, I didn't see an officer come down on the Division st. before the truck left. Are you able to follow up with the police dept? I think the truck comes on very Monday. Thanks."

I sent a note to Councilman Crifasi about this matter. I also believe that when Quiznos applied for their permit before Planning the subject of loading hours came up. I'll ask Chris A. about it.

"I have been a commercial tenant several years. Recently my landlord informed me I have to pay a road tax for paving that was done in 2003 on Industrial Rd. And he claims the bill is over a 10 year period. Shouldn't this be the property owners responsibility? And is it true that they are making installment payments?"

"The road improvement assessment which you refer to as a tax is set by law for commercial properties on streets that are improved outside the residential area; the theory being (based on the law) that the street is used primarily for the benefit of the commercial residents of that street. I question why it took 5 years to memorialize the assessments, but depending on whether your lease stipulates your liability, you could be liable. Check with your attorney to review the lease and ask the landlord for the paperwork they received from the town.

"I would tell your landlord to fight this road improvement assessment. I know for a fact that the Tow truck company at the end of Industrial Road had fought it and did not have to pay it. He has at least three tow trucks with one that has a GVW of 70,000 lbs"

"Both posters have good points re: the tow truck business at the northern end of Industrial road. However, if in fact the owner of that business has a Floral Lane address, even though he parks his rigs on the Industrial Road side of his property, does he have a variance to operate that business in a residential zone? Additionally, does he also have a variance that would allow him to park more than one commercial vehicle on his residential property? It also seems evident that he uses Industrial Road exclusively to access that parking area on Industrial Road. Seems to me you can't have it both ways."

"Yes, a portion of the yellow curb has been painted over with grey paint, I can only assume, to allow more parking. Point being that cars are now that much closer to the intersection making it harder to see if cars are traveling into the intersection. I could also imagine how this might hamper larger trucks, emergency vehicles and etc from navigating turns with these added vehicles there. Isn't there some required distance that must be left yellow for just this reason, or where they just correcting the actual measurements? Seems things were better the way they were. I've almost gotten t-boned three times since the curbs have been re-painted.

"A few years ago the the curbs were over painted [I assume he/she means too much yellow -Nick], so this summer they were repainted to the proper lenth and gray paint was used to cover over the other paint...So where you see gray paint its only there to cover up the old yellow. Now every corner in carlstadt has the proper yellow markings"

"So, I wrote asking if Lincoln School was going to be torn down? I really don't think it should be. I think that the building itself should be rehabilitated for re-use. It's structurally solid (from the looks of it; I haven't done any engineering analysis), and masonry is labor-intensive.

The project on 3rd street is for senior housing. It partially satisfies the town's requirement to build low-income housing but it is specifically for seniors not low-income families.

The meeting are held on the third Monday of the month in town hall and, yes, they are open to the public.

"Is Lincoln School going to be torn down? I heard that it was going to be demolished for the construction of a park. Given the high cost of building (and good 98-year-old masonry at that), wouldn't it make more sense for the building to be used partially for housing (loft conversions, allowing a certain percentage for moderate income and a certain for artists) and partially for community arts programs? Also, given that the new public school is LEED certified for 'green'-ness, wouldn't it ultimately be more green for the town to save the huge environmental impact that building demolition has? Given that that is a solid (looking, anyway, I don't have details as to any histories of structural problems of the building) building, it seems to me a shame to open the space up for a park. There's a baseball field nearby, and it's next to the cemetery. Such a solution (mixed residential/arts) could make the town more appealing to young people, and would help to solve Carlstadt's recent problems with a lack of state-mandated affordable housing."

I know hearing from me may seem strange or surreal to you, but after my mother died 6/15/81, I couldn’t deal with living in our house without my family. I sold the house in 1983 and moved to Ridgewood, then to Rutherford and then to California where I currently live. I have a beautiful home in Valencia, California, have 2 Miniature Schnauzers and live with my companion of 19 years. Much has happened in the interim. I have had a very good life out here.

I would very much like to speak with you in the near future. There is a great deal to share.

The Board of Ed. is an autonomous body operating within the town. They don't need permission from the Mayor and Council to build anything. They only need to show that whatever they wish to build fits within the town's Master Plan.
To pay for this project, the BOE submitted a bonding proposal to a townwide vote. The bill passed.

Is there a reason that the berm in front of the new school isn't mowed? Is it a case that they're trying to grow wildflowers or is it just neglect? It looks really bad right now.

Thanks for all the responses concerning the berm in front of the school. I've been away and that's why they haven't been posted. In the meantime, the berm has been mowed. Apparently the problem is that the BOE is in the process of accepting bids for a new landscaper.

"The Planning Board approved the excessive construction of the number of homes at the site based on the agreement by the developer that the narrow street would not provide for parking. This was based on the safety issue re: emergency vehicle access. (fire, ambulance, etc). The developer, apparently did not advise the buyers of this restriction and was never held accountable. The project was approved with too many houses on too small of a lot in 1995, prior to the present administration taking over. It's an unfortunate situation that cannot legally be reversed without jepordizing the safety of the residents of the area. When this issue first surfaced in "97" or so, the residents were encouraged by the Mayor and Council to seek remedy from the developer. Apparently they neglected to do so."

"It is extremely easy to put the parking issue back on the owners, but the town needs to take some responsibility. It wasn't until the 7th house was in construction did the signs for "No parking" go up. Why not when the fire hydrants went in? I am sure CO's were in place for the other 6 houses in the development, why no signs? The same safety issues were in play from the time the first house was built. For that matter, it wasn't until 2001 was a stop sign finally placed at the end of the street."

"We, the buyers, did not approve that site plan either, but we have to suffer with it. It would be nice if the current administration stepped up and attempted to find some sort of solution to the problem instead of just ignoring it. After all, we are taxpayers and, therefore, constituents of this administration. As a point of reference, has anyone driven on Division when cars are parked on both sides? If an emergency vehicle can make it through that narrow space, it can certainly navigate Patricia Court if cars were restricted to parking on one side of the straight sections."

I agree that it looks pretty bad when people put out their trash days before it is picked up or put out heavy trash on light trash night and it just gets left there. However, last time I checked into this, there was a loophole in that the law only says that you must pull in your empty trash cans after garbage pickup. There's nothing on the books about how early you're allowed to put trash out. I don't know if this has been changed.

c) After collection, any empty containers shall be removed from the curbside promptly, but no later than 6:00pm of the day of collection.
d) Failure to comply with this section shall result in an immediate summons being issued. This may be done without the necessity of first issuing a warning. Fines issued shall be in the amount prescribed by Section 8 of this Ordinance.
e) The Carlstadt Police Department and all Borough Enforcement Officers shall be charged with and authorized to enforce this Ordinance."

10-3.11 Permit Parking.

a. In Front of Private Driveways.

Paragraph 3. Eligibility; Limit; Display. An owner of a private driveway shall be eligible to apply for one permit for his/her own motor vehicle or for a member of the household or a tenant therein authorized by the owner to park in front of the private driveway. [cut . . .] In no event shall there be more than one permit issued per private driveway. The permit shall be 5 1/2" x 8 1/2" in size, shall bear an appropriate certification of authenticity and shall be displayed prominently within the vehicle when it is parked so as to be seen from the middle of the street.

Paragraph 5. Restrictions. A motor vehicle shall not be permitted to be parked in front of a private driveway unless the owner of the private driveway or a member of the owner's household or a tenant has been issued a valid permit and the permit is properly displayed.

Councilman Crifasi replys: "The Zoning Officer oversees the issuing of permits, but the Police Dept enforces the ordinance. Yes, the zoning officer can write tickets for non-permitters, but it is not his sole job. He covers a range of enforcement: property maintenance, approve building plans, COZ's for new home purchases, certain construction permits, etc.

In summary, neither the zoning officer nor the Police can get every violator on their own. They need your help!!!! There is a "confidential" phone number to call in violators WITHOUT your name known. You can even call in AFTER HOURS and leave a message and they will follow up the next business day. The number is 201-939-2304"

However, if you go to the forums you will find that a resolution has been passed which will require the closing of Lincoln and Washington Schools and the demolition of Lindbergh. A school which will serve the entire Borough is to be built just north of where Lindbergh stands today .

Is anyone else disgusted with the amount of car and the lack of trees on our streets. It seems like every tall was cut down and replaced with a 9.99 one from home depot only to enhance the cars parked from corner to corner spilling into the yellow zone. Even in Garfield and Lodi which our town is starting to resemble ticket are issued to residents not following the laws.

It should be noted that many of the tall maple trees that you see around town have short life spans as trees go, somewhere around 60-75 years. These trees become very dangerous as they age due to their tremendous size and shallow root system. It appears to be an oversite, but the ordinance, 16-8.1, only states that [empty] trash cans must be removed by 7pm on the day garbage is picked up. It says nothing about how early you can put out trash to be collected.

Plant larger trees. Yes they cost a LITTLE more but at least we'll have trees that provide shade and beautify our town, not the twigs that are being planted now. It seems as though, most of the new trees are replaced before they get to be too large. Carlstadt used to be a tree lined town, every street had fully grown trees. All of a sudden every single tree in town had to be cut down. was there truely a need to cut them down??

How does one change the ordinance? The garbage sitting out a day or more makes this town look undersirable. I do hope that it can be changed. Besides, think of the fines that could be collected also.

I have noticed that many drivers forget that the sidestreets are 25 MPH. I have even seen a member of the fire dept, tear up the streets in his jeep. I know that we have the MPH clock on Monroe, but what about sidestreets, WHERE KIDS PLAY. I hope it does not take a tragedy to see things get changed.

The Mayor responds:
The answer is "no." School admittance is based on residency and residency only. I feel bad for the person but imagine if everyone that worked in Carlstadt (40,000+) sent their children to school here. The burden on the taxpayers would be astronomical.
They should move into town. I have every confidence that they would love it here.

I would like to complain about Third St. pavement between Central & Summit. There are so many potholes that need to be filled. You cannot go up the middle of the street without hitting long patches of missing pavement. I understand we are not on the list for re-pavement but can we at least have the potholes filled. Thanks!
